By placing an order you accept these terms and conditions. We reserve the right to change these terms and conditions at any time and without notice. It is your responsibility to regularly check these terms and conditions for any changes.
1. General Information
You agree all goods ordered by you are acquired by you for business purposes and accordingly that the Consumer Guarantees Act 1993 does not apply.
For orders via this website, during the registration process, you must choose a username and password. You are responsible for all actions taken under that username and password and must only purchase from this website under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password. We will never under any circumstances email or contact you and request your username or password. Any requests for this type of information should be treated as fraud and reported to us immediately.
If there are any changes to the details supplied by you it is your responsibility to inform us as soon as possible.
You undertake that all details you provide to us for the purpose of ordering or purchasing goods or services are correct, that the credit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
We reserve the right to terminate our contract with you and to suspend or terminate your access to this website immediately and without notice to you if:
- You fail to make payment to us when due
- You breach any of our terms and conditions
- When requested by us to do so, you fail to provide within a reasonable time frame, enough information to let us check the accuracy and validity of any information supplied by you, or your identity.
Customers outside of New Zealand cannot purchase via our website and should contact us directly to arrange their orders.
3. Our Contract
When you place an order, you will receive an acknowledgement confirming receipt of your order. This confirmation will only be an acknowledgement and will not constitute acceptance of your order. A contract will not be formed until we send you confirmation by email that the goods which you have ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.
4. Pricing and Availability
We reserve the right to change information, prices, specifications and descriptions of listed goods at any time and without notice.
All orders are subject to availability and confirmation of the order price. Whilst we try to ensure that all prices, details and descriptions on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
All prices are exclusive of Goods and Services Tax (GST) which is payable at the prevailing rate in addition to the stated price. International orders are not subject to GST. Our delivery costs (see Delivery Charges) will be charged in addition.
We accept [Visa (includes Visa Debit), Mastercard, Diners Club and American Express] payments through our website for orders made through this website, or as otherwise agreed in writing for any other orders. All payments via our website are processed using SSL (Secure Socket Layer) protocol, whereby sensitive information is encrypted to protect your privacy. All transactions are in New Zealand Dollars.
If the issuer of your credit card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
We retain ownership of goods purchased from us until payment in full (including of any delivery or other charges payable by you).
Stock permitting, all orders are dispatched within 2-3 working days of being accepted. For goods that may take longer than 2-3 working days to dispatch, we will endeavour to contact you to advise the expected dispatch date. Dispatch times and delivery times are estimates only and we will not have any liability in respect of any delays in delivery.
Please see Delivery Charges for our delivery charges. We may deliver each item ordered separately if we choose for supply or other reasons. If this is the case you will not incur any extra delivery cost. We reserve the right to refuse orders and/or negotiate delivery charges.
We only ship to residential or business addresses. PO Boxes and Private Bags are not accepted for security reasons.
7. Shortages, Damage or Loss in Transit
If you consider there is a shortage in the quantity of goods delivered, you must notify us within 7 days of delivery and allow us reasonable time to investigate your claim. Our liability for any shortage in the quantity of goods delivered is limited to making up the shortage.
We ensure that all orders are carefully checked and adequately packaged when dispatched. Prior to acknowledging delivery to the carrier, you should ensure that the complete consignment has been delivered. Should there be a shortage or visible damage to outer packaging, the carrier's note must be endorsed accordingly. Within 7 days of receipt of consignment you must ensure that all goods received are in good order and condition. No damage claims will be considered after 7 days of receipt of goods.
All orders of goods bought new and delivered within New Zealand are insured against damage or loss during transit up to the value of NZ$1500 excluding GST. While we do not accept any liability for goods damaged or lost in transit that exceeds the value of the loss or damage insurance applying to that delivery, details of any claim against the carrier should be advised to us and we will assist where possible.
8. Cancellation & Returns
You may cancel your order up until we have dispatched the goods and receive a refund. Following dispatch of the goods, we will only accept “change of mind” returns if approved by us before you send the goods back and the goods are returned in their original condition (without any cuts, tears, crushing, creasing or damage to the packaging or contents that may prevent us from reselling the goods as new, including manuals, accessory items, batteries, screen protection plastic that was supplied with the goods). You must pay the freight cost of returning the goods and we may charge a restocking fee to cover our administration costs incurred in the original transaction and reversing the purchase.
Instead of any warranty, condition or liability implied by law, should any goods ordered be found to be defective within the manufacturer’s stated warranty period for the goods (if any) or otherwise within 12 months of the date of delivery, provided you contact us promptly to arrange for the defective goods to be returned, we will (at our sole discretion) repair or replace the goods, or refund the price paid. (This does not cover damage from misuse, accident, neglect or improper operation, maintenance, installation, modification or adjustment.) To the extent permitted by law, these are your sole remedies in relation to any defective goods or any default by us under these terms and conditions, and in no circumstances will our liability to you exceed the price of the goods, nor do we accept any liability for any direct loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of this website or supply of any goods by us.
You must ensure that the goods ordered are fit and suitable for the purpose for which they are required – we will be under no liability if they are not. If plans, specifications and/or requirements have been given to you, it is your responsibility to ensure that the goods supplied by us will be satisfactory to meet such plans, specifications and/or requirements.
These terms and conditions are to be construed in accordance with the laws of New Zealand and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the New Zealand courts.
11. Entire Agreement
The terms and conditions above and elsewhere on this website constitute the entire agreement between us and supersede any and all preceding and contemporaneous agreements. Any waiver of any of the terms and conditions on this website will be effective only if confirmed in writing by one of our directors.
